Prisoner Transfer Treaty
A bilateral treaty allowing convicted foreigners to serve the remainder of a Thai sentence in their home state. Thailand has active treaties with the US (1982), UK (1990), Australia (2002), and Canada (2002).
A prisoner transfer treaty (PTT) is a bilateral agreement allowing sentenced foreign nationals to be transferred from the sentencing state to their home state to serve the remainder of their sentence. The Thai domestic framework is the Act on Cooperation between Thailand and Foreign States in the Execution of Penal Sentences B.E. 2527 (1984). Transfer is not automatic — it requires (a) a bilateral treaty between the two states, (b) the consent of both governments, and (c) the consent of the prisoner. Common eligibility constraints: conviction must be final (appeals exhausted or waived); minimum one year remaining on the sentence; the receiving state enforces the Thai sentence under its own law, which may adapt the effective term.
