Bail

Conditional release of an accused person pending trial — denied or set unaffordably high for serious Thai charges, particularly drugs, lèse-majesté, and trafficking.

Bail in Thailand is granted at the discretion of the court. For offences in the most-punished categories — Category-1 drug possession or trafficking, §112 lèse-majesté, human trafficking under the Anti-Trafficking in Persons Act — bail is routinely denied. Even where bail is theoretically available, surety amounts are frequently set at levels that exceed a defendant's family resources. The practical consequence is that the choice between "fight your case and stay in remand" and "plead and go home in months" is not free.
