Section 79 (Thai Criminal Code)

The companion mitigation provision that enumerates non-confession grounds a court may use to reduce sentence (youth, intoxication, provocation, etc.).

Section 79 lists additional grounds — beyond §78 — on which a Thai court may reduce a sentence: youth at the time of offence, intoxication that was not voluntarily induced, severe provocation, and other equitable factors. In practice §78 dominates because it has a single, predictable trigger (confession). §79 is more discretionary and less reliable from the defendant's perspective, so it rarely substitutes for a guilty plea. Both sections together form the formal mitigation framework Thai courts work within at sentencing.
